Members Posting Copyright Martial II

A recent law suit has came to my attention about a Blog being sued over Copyright infringements. This subject was discussed here : http://www.adminaddict.net/forum/security-legal-disputes/members-posting-copyrighted-content-1572/

Anyhow, I was reading this thread and noticed that a like of owners or admins stated they will remove the martial after being contacted by the authors. But what happens when you're sued first? Generally speaking a plaintiff will have their attorney issue you a Cease and Desist letter. The letter basically states either stop what you're doing or face a law suit.

In recent times I ran across a blog that was sued first and questions asked later. It seems there is an attorney in Las Vegas who has figured out how to make money is a down economy by buying up copyrights and suing websites.

I have been following that issue a bit.

I believe there is protection for forum owners for content they did not put up or know about. But no protection for forum owners if they themselves put up the content.

Fairly sure that was the conclusion. Although many discussions have been taking place about that article.

 

I do not have an answer for you.

All I can say is to be proactive about removing copyright protected material as soon as you see it - and as soon as its reported by other members.

As the owner of the forum, its important that you set an example and not copy/paste material that does not belong to you.

 

Ya, I went back and edited a bunch of threads/post. I ran across some post where members had posted the entire article without a source link to boot. So I deleted those threads.
